Tutoring Contract – As Needed

Before the initial session, Tutor will send an invoice to the Client via Square. The Client is required to submit payment and maintain a valid credit or debit card on file to enable billing for all tutoring sessions. — For sessions scheduled on an as-needed basis, invoices will be prepared in advance and payment will be processed automatically on the morning of the scheduled session using the payment method on file. — The Tutor will send an email detailing the scheduled session, charges, and any relevant updates prior to processing payment. — If a valid payment method is not maintained on file, a $10 monthly administrative processing fee will be added to cover additional time required for manual billing and payment follow-up. Failure to maintain a payment method on file may result in suspension or cancellation of tutoring services. — Invoices are due upon processing. Any balance that cannot be successfully processed may result in cancellation of the scheduled session until payment is resolved.

Tuition shall be calculated at a rate of $70 per 1-hour session, $55 per 45-minute session, and $40 per 30-minute session of tutoring. Tuition rates may be adjusted from time to time by the Tutor and shall become effective after having given the Client seven (7) days written notice. In some cases, extra materials may be required for certain types of lessons. If additional materials such as workbooks, manipulatives, and/or books specific to the Student’s school are necessary, the Student/Client shall incur all costs for such materials. Consequently, those materials will be considered the Student/Client’s property and will remain the Student/Client’s property after tutoring is discontinued. Any materials purchased by the Tutor shall be considered the Tutor’s property, and will remain the Tutor’s property after lessons are completed. Special situations will be assessed as needed.

Tutoring sessions are scheduled on an as-needed basis and are not reserved as a recurring weekly time. Sessions must be scheduled in advance and are subject to Tutor availability. — The Tutor does not guarantee ongoing availability for specific days or times unless sessions are booked in advance. — The Tutor reserves the right to prioritize regularly scheduled clients when offering session availability.

Cancellations by the Student/Client must be communicated via email or text at least 24 hours in advance of the scheduled session. — Sessions canceled with at least 24 hours notice will not be charged. — Sessions canceled with less than 24 hours notice will be charged in full, as the time has been reserved. — Because payment is processed on the morning of the scheduled session, late cancellations (less than 24 hours notice) will not be refunded. — If the Tutor must cancel due to emergency, no fees will be charged and the session may be rescheduled at a mutually agreed upon time.

With at least 24 hours notice, Students/Clients may request to reschedule a session. Rescheduling is subject to Tutor availability and is not guaranteed.

Fees are based on the scheduled session time and will not be adjusted for late arrival by the Student. — “No-Shows” (failure to attend a scheduled session without notice) will be charged in full and are not eligible for rescheduling or refund.

This tutoring agreement may be terminated by either party at any time with written notice. Any sessions already scheduled after the requested date of termination will still be subject to the cancellation agreement.

NO WARRANTIES: While the Tutor is confident in her skills and teaching ability, the Tutor makes no promises or warranties with regard to a student’s performance as a result of any tutoring provided. — RESPONSIBILITIES OF THE TUTOR: At no time will the Tutor be required or obligated to execute homework or assignments on behalf of the Student. STATUS OF THE TUTOR: It is expressly understood that the Client retains the services of the Tutor as an independent contractor and not as an employee. The Tutor shall be responsible for her insurance and for all statutory declarations and contributions with regard to income tax. — RELAXATION OF TERMS: No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms. — WHOLE AGREEMENT: This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties.
