Tutoring Contract – Fixed

Before the initial session, Tutor will send an invoice to the Client via Square. The Client is required to submit payment and maintain a valid credit or debit card on file to enable automatic billing for all future sessions. — Recurring weekly sessions are billed monthly. Charges for all sessions scheduled during the calendar month will be processed automatically on the first business day of each month using the payment method on file. — If a valid payment method is not maintained on file, a $10 monthly administrative processing fee will be added to the invoice to cover the additional time required for manual billing and payment follow-up. Failure to maintain a payment method on file may result in suspension or cancellation of tutoring services. — Invoices are due upon receipt. Any balance not paid within 3 calendar days of the invoice date will incur a late fee of $15 per week until paid in full. Tutoring sessions may be paused or canceled for accounts with outstanding balances, and future sessions are not guaranteed until payment is current.

Tuition shall be calculated at a rate of $70 per 1-hour session, $55 per 45-minute session, and $40 per 30-minute session of tutoring. Tuition rates may be adjusted from time to time by the Tutor and shall become effective after having given the Client seven (7) days written notice. In some cases, extra materials may be required for certain types of lessons. If additional materials such as workbooks, manipulatives, and/or books specific to the Student’s school are necessary, the Student/Client shall incur all costs for such materials. Consequently, those materials will be considered the Student/Client’s property and will remain the Student/Client’s property after tutoring is discontinued. Any materials purchased by the Tutor shall be considered the Tutor’s property, and will remain the Tutor’s property after lessons are completed. Special situations will be assessed as needed.

After completing the Initial Assessment, Tutor and Client shall agree upon a regular weekly tutoring schedule. Tutor and Client/Student shall be locked into the agreed-upon schedule on a weekly basis.

Cancellations by the Student/Client must be given to the Tutor via email or text by the last business day of each month for the upcoming month (For example, all cancellations for September must be submitted by the last business day of August). Once appropriate notice is given, Tutor shall remove the corresponding charges from the upcoming invoice. If the Student/Client needs to cancel a session that has already been billed for the current month, the Client/Student may request a *recorded session in lieu of the scheduled session. No refunds or roll-overs shall be applied. *note: recorded sessions may not be as long as the original scheduled session due to the time it takes to set up for recording, processing, and emailing the recorded session to the Student/Client. Should the Tutor need to cancel any sessions due to emergencies, the Client shall incur no fees. In the case that a lesson was pre-paid, the Tutor shall reschedule the appointment at a time agreeable to both parties. If, for some reason, the lesson cannot be rescheduled during the same week, the Tutor and Student/Client will agree to either (1) have the pre-paid tuition refunded, or (2) apply the pre-paid tuition toward a future lesson.

With 24 hours notice, Students/Clients may request to reschedule a scheduled session. Student/Client must access the Tutor’s online schedule and request a rescheduled session that will occur within the same month of the original session. Rescheduling must be agreeable to both parties, and Tutor will reschedule as time is available. If the Tutor is unable to accommodate the Student/Client with a rescheduled lesson, no refunds or roll-overs will be applied, and a recorded lesson may be requested by the Student/Client.

Fees are calculated according to the times stipulated in the schedule and no adjustment shall be made for time lost because of late arrival by the Student. Any lost time because of the late arrival of the Tutor shall be compensated for by extending a lesson by the amount of time that is lost. If the Tutor or Student/Client is unable to have the lesson extended, the Tutor shall subtract the time she is late from the owed tuition. In the case that a lesson is pre-paid, the Tutor and Student/Client will agree to either: (1) have the pre-paid portion of the tuition refunded, or (2) apply the pre-paid portion of the tuition toward another future lesson. “No-Shows” are lessons in which the Student does not show up to his or her lesson with no notice to the Tutor. No refunds or roll-overs will be applied for No-Shows, and a student who has more than two (2) No-Shows will be subject to termination of any further tutoring lessons.

This tutoring contract may be terminated by either party at any time by giving the other party seven (7) days prior written notice. Any sessions already scheduled for the next 7 days shall still be billed, and any sessions scheduled beyond the 7-day period will be refunded. Tutoring sessions will be discontinued at the end of the 7-day period, and the Tutor may open that time up to other Clients/Students for scheduling.

NO WARRANTIES: While the Tutor is confident in her skills and teaching ability, the Tutor makes no promises or warranties with regard to a student’s performance as a result of any tutoring provided. — RESPONSIBILITIES OF THE TUTOR: At no time will the Tutor be required or obligated to execute homework or assignments on behalf of the Student. STATUS OF THE TUTOR: It is expressly understood that the Client retains the services of the Tutor as an independent contractor and not as an employee. The Tutor shall be responsible for her insurance and for all statutory declarations and contributions with regard to income tax. — RELAXATION OF TERMS: No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms. — WHOLE AGREEMENT: This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties.
